§ 3-2. Penalty for violation of chapter.

  • Any person violating any of the provisions of this chapter shall, upon conviction, be punished by a fine of not less than $100.00 nor more than as provided in section 1-11 of this Code, and a separate violation shall be deemed to be committed on each day during or on which a violation occurs or continues. In determining the amount of the fine to be levied under this section, the court having competent jurisdiction over the case shall consider the following factors:

    (1)

    The degree of the threat to life, health and safety to the residents of the city posed by the violation.

    (2)

    The duration of the violation.

    (3)

    The willfulness and intent of the person guilty of the violation.

    (4)

    The degree of control of the person guilty of the violation over the existence or prevention of the violation.

    (5)

    Prior convictions under the provisions of this chapter of the person guilty of the violation.
