§ 2-101. Duties.

  • The city attorney shall perform the following duties:

    (1)

    Conduct all law business of the city, and draw such ordinances, deeds, leases, contracts and other papers as may be required by the mayor or city council or any committee thereof.

    (2)

    When required by the mayor or city council or any committee thereof, furnish written opinions upon any subject submitted to him and pertaining to the city and its interests.

    (3)

    Advise all city officers in matters relating to their official duties, when called upon.

    (4)

    Upon the expiration of his term of office or resignation therefrom, forthwith turn over to his successor in office all deeds, leases or other papers in his hands belonging to the city, together with a statement showing what action, if any, has been taken in any action pending wherein the city is a party, and giving to his successor such information as he may possess with respect to proof or witnesses in such action.

    (5)

    In all cases wherein suit is commenced against the city, and the city has or may have its remedy against any person, forthwith cause to be served upon such person a written notice of the commencement of such suit, and a copy of the complaint, when filed, requiring such person to defend in such suit.

    (6)

    Whenever a judgment shall be rendered in favor of the city, cause the necessary process to be issued, and enforce payment, as speedily as possible, of such judgment and costs.

    (7)

    Whenever any conviction is had for a violation of any provision contained in any ordinance of the city, cause the judgment rendered to include the costs attending such conviction and suit.

    (8)

    Attend each meeting of the city council, when not otherwise professionally engaged, sick or excused, and, if he shall fail to so attend such meetings, the city council may adjust the salary.
