§ 1-16. Distribution of Code of Ordinances.

  • (a)

    The original Code of Ordinances of the City of Pontiac, Illinois, hereinafter Code Books, are the property of the City of Pontiac and shall be maintained by the city as hereinafter provided.

    (b)

    Code Books shall be distributed to the mayor, city clerk, aldermen, city attorney, city administrator and department heads for their use as officer/employees of the city and each such individual shall be responsible for the Code Book in such party's possession and shall surrender same to the city upon the cessation of service in the above named capacity or otherwise on demand.

    (c)

    The city shall also provide one Code Book to the Pontiac Public Library and two Code Books to the Circuit Court of the Eleventh Judicial Circuit, Livingston County, Illinois to be used by the judges and for placement in the Livingston County Law Library, which Code books shall remain the property of the city and shall be surrendered and returned to the city upon request.

    (d)

    Additional copies of the Code Book as shall remain available after the distribution thereof in accordance with the foregoing subsections shall be available for lease by members of the public, including but not limited to attorneys and law firms, provided that there shall be an initial lease fee for the lease of a Code Book and additional fees for the mandatory supplement service in amounts and upon such frequency determined by the city council from time to time, and each such party leasing a Code Book shall execute a lease agreement in a form approved by the city attorney.

    (e)

    The city clerk, or his designee, shall establish a system for the public leasing of Code Books, and for the billing and collection of fees, shall maintain an accurate record showing names and addresses of all persons in possession of a Code Book, City of Pontiac, Illinois as hereinabove provided, shall be responsible for updating the Code when supplements are provided by the Municipal Code Corporation or any other contractor for the city and, shall notify all persons in possession of a Code Book of the availability of such supplement and that the Code Book must be returned to the city for insertion of the supplement within 14 days from the date of such notice.

    (f)

    Any person leasing or possessing a Code Book shall return the Code Book to the city upon termination of his privileges for any reason, including nonpayment of lease charges, or otherwise upon request of the city.

    (g)

    Any person fails to surrender the Code Book as hereinabove provided, or who shall cause the destruction of any Code Book, be subject to a fine in the amount of $250.00.
